TERMS OF SERVICE: CUSTOM APPAREL PRINTING SERVICES
1. PROOFING, APPROVALS, ARTWORK & ORDER FINALITY
• Customer Artwork Supply: The Customer is solely responsible for providing any and all artwork, logos, graphics, and files to be printed on the garments.
• Exact File Printing: Submitted artwork will be printed exactly as provided—including size, layout, overall quality, color profile, and image resolution—unless otherwise discussed in writing. Cardan Apparel Custom Prints is not responsible for low-resolution, pixelated, blurry, or incorrectly scaled output resulting from poor-quality source files.
• Color & Pressing Variations: Colors displayed on digital screens may vary from physical prints due to monitor calibration, fabric composition, and heat-pressing processes. The Customer acknowledges that minor color shifts may occur during printing and pressing, and such variations shall not be considered a defect.
• Final Approval & Non-Refundable Policy: The Customer is solely responsible for reviewing all artwork and order specifications before submission. Due to the custom, made-to-order nature of our services, all sales are final. No refunds, returns, or exchanges will be provided once production has commenced or an order has been delivered, except at the sole discretion of Cardan Apparel Custom Prints.
2. TURNAROUND TIMES & DEADLINES
• No Time Guarantees: Estimated production and shipping timelines are provided strictly as non-binding estimates. Cardan Apparel Custom Prints imposes no maximum time limit to complete or fulfill an order.
• Exceeding Deadlines: Even where a specific completion or delivery deadline has been expressly agreed upon, Cardan Apparel Custom Prints reserves the right to exceed said deadline without penalty, liquidated damages, order cancellation, or price reduction. Late delivery does not constitute a breach of contract.
3. LIMITATION OF LIABILITY & PHYSICAL HARM DISCLAIMER
• Adverse Effects: Cardan Apparel Custom Prints is not responsible or liable for any adverse reactions, allergies, skin irritation, illness, or physical discomfort resulting from inks, dyes, pretreatments, fabrics, or materials used in the garments or printing process.
• Injury & Damages: In no event shall Cardan Apparel Custom Prints, its owners, or employees be liable for any direct, indirect, incidental, consequential, or punitive damages—including personal injury, property damage, or loss of profits—arising out of or connected with the use, wear, or resale of any products supplied.
4. ORDER CANCELLATION & COMPANY TERMINATION RIGHT
• Right to Terminate: Cardan Apparel Custom Prints reserves the absolute right to terminate, cancel, or refuse service on any order at any time, for any reason, including but not limited to artwork copyright concerns, offensive content, or supply shortages.
• Reimbursement Limits: In the event of a Company-initiated cancellation, reimbursement to the Customer shall be limited strictly to funds remaining after deducting all non-recoverable costs already incurred by Cardan Apparel Custom Prints. Deductions include, but are not limited to, artwork setup, labor/man-hours expended, admin fees, and unreturnable raw garment or material purchases.
5. CUSTOMER ARTWORK INTELLECTUAL PROPERTY
• Warranty of Rights: The Customer warrants and guarantees that they hold the full rights, licenses, or explicit authorization to use and reproduce all submitted designs, trademarks, logos, and copyrighted material.
• Indemnification: The Customer agrees to defend, indemnify, and hold harmless Cardan Apparel Custom Prints against any claims, lawsuits, legal fees, or damages arising from trademark or copyright infringement claims related to Customer-submitted artwork.
6. GARMENT DISCREPANCIES & INDUSTRY TOLERANCES
• Manufacturing Variations: Minor variations in garment color, sizing (up to \pm 1 inch), dye lots, and exact print positioning (up to \pm 0.5 inches) are standard within the custom apparel industry and shall not be deemed defective.
• Customer-Supplied Garments: If Cardan Apparel Custom Prints agrees to print on customer-supplied items, the Company accepts zero liability for damage, scorched material, or misprints occurring during production, and replacement garments will not be provided.
7. CLAIMS & NOTICE PERIOD
• Any claim regarding defective printing or missing items must be submitted in writing with photographic proof within 72 hours of delivery receipt. Failure to notify Cardan Apparel Custom Prints within this timeframe constitutes full acceptance of the order as delivered.
